Terms of Use

By downloading, accessing, or using the Savoryy mobile application ("Savoryy," the "App," or the "Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

These Terms constitute a legally binding agreement between you and Savoryy ("we," "us," or "our") governing your use of the Service.

Savoryy is an AI-powered kitchen companion application that provides meal planning, recipe generation, grocery optimization, drink recipes, and related culinary tools. The Service includes both free and paid subscription tiers.

In addition to AI tools, Savoryy includes a Community feature where users can share recipes, drinks, photos, tips, questions, and video links; follow other creators; react to and comment on posts; save recipes to a personal library; and purchase premium "secret recipes" from other creators.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice.

Savoryy Pro is an auto-renewable subscription that provides unlimited AI generations, premium drink recipes, saved favorites, full generation history, and priority AI responses.

Subscription Details: - Title of Subscription: Savoryy Pro - Length of Subscription: 1 month - Price: $6.99 USD per month - Payment is charged to your Apple ID account at confirmation of purchase - Subscription automatically renews each month unless auto-renew is turned off at least 24 hours before the end of the current billing period - Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of $6.99/month - Subscriptions may be managed by you and auto-renewal may be turned off by going to your Apple ID Account Settings after purchase - Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription

Premium Recipe Purchases: Certain community recipes ("Secret Recipes") may be offered by creators for one-time purchase. These purchases are processed securely via Stripe and are non-recurring. You may also restore a previous purchase if you reinstall the app or switch devices.

Free Tier: The free plan provides 3 AI generations per month with access to food and grocery tools. No payment is required for the free tier.

Savoryy includes community features that allow users to create, share, and interact with content. When you post recipes, drinks, photos, comments, tips, questions, or video links in the Community, you are solely responsible for the content you submit.

Content License: By posting content on Savoryy, you grant Savoryy a worldwide, non-exclusive, royalty-free license to host, display, reproduce, and distribute your content within the Service for the purpose of operating and promoting the community features. You retain ownership of your content.

Public Visibility: Community posts, your display name, username, and avatar are visible to other users. Your email address is never displayed publicly.

Content Moderation: We reserve the right to review, remove, or hide any content that violates these Terms, our Community Guidelines, or applicable law. We may also suspend or terminate accounts that repeatedly post prohibited content.

Reporting: You can report inappropriate content through the app. We will review reports and take action where appropriate.

When participating in the Savoryy Community, you agree to the following guidelines:

Permitted Content: - Original recipes, drinks, and cooking tips you have the right to share - Food photography and videos you own or have permission to share - YouTube or video links to content you have the right to reference - Constructive comments, reactions, and questions

Prohibited Content: - Content that is unlawful, harmful, threatening, abusive, harassing, defamatory, or hateful - Content that infringes the intellectual property or privacy rights of others - Spam, scams, or misleading content - Content that promotes eating disorders, unsafe food practices, or health misinformation - Sexually explicit or violent content - Content that advertises or sells products or services outside of Savoryy's built-in premium recipe feature - Impersonation of another person or brand

We reserve the right to remove content and restrict access for users who violate these guidelines.

Creators may designate certain recipes as "Secret Recipes" and charge a one-time fee for access. The following terms apply:

Revenue Split: When a user purchases your premium recipe, you receive 80% of the purchase price. Savoryy retains a 20% platform fee.

Payment Processing: All purchases are processed via Stripe. Savoryy is not a party to the transaction beyond facilitating the platform and processing payment.

Refunds: One-time recipe purchases are generally non-refundable once the content has been unlocked, except where required by applicable law. If you experience a technical issue that prevents access, contact us to request a review.

Creator Responsibilities: If you sell premium recipes, you are responsible for: - Ensuring you own or have the rights to the content you sell - The accuracy and safety of the recipes you publish - Any applicable taxes on your earnings - Maintaining the quality of content you offer

Dispute Resolution: Savoryy is not responsible for disputes between creators and buyers regarding recipe quality. We may, at our discretion, refund a buyer and deduct the amount from future creator earnings if a recipe is found to be materially misrepresented.

Creators with available earnings may request a payout. Payouts are processed as follows:

Payout Methods: Creators may connect a Stripe account via Stripe Connect for automatic payouts, or request manual payout via PayPal, Venmo, or bank transfer.

Minimum Threshold: A minimum balance of $5.00 USD is required to request a payout.

Processing Time: Manual payouts are processed at Savoryy's discretion and may take up to 14 business days. Automatic payouts via Stripe Connect depend on Stripe's processing schedule.

Tax Obligations: Creators are responsible for reporting and paying any taxes due on their earnings. Stripe Connect users may receive tax documentation directly from Stripe. Savoryy does not provide tax advice.

Account Verification: To receive payouts, you may be required to verify your identity and payment details. We reserve the right to delay or withhold payouts if we suspect fraudulent activity or if verification is incomplete.

The Service uses artificial intelligence to generate recipes, meal plans, and other culinary content. All AI-generated content is provided "as-is" for informational and inspirational purposes only.

We do not guarantee the accuracy, completeness, safety, or suitability of any AI-generated recipe, ingredient suggestion, or nutritional information. You are solely responsible for verifying ingredient safety (including allergens), cooking instructions, and nutritional data before use.

Savoryy is not a substitute for professional medical, nutritional, or dietary advice. Consult a qualified professional before making dietary changes, especially if you have food allergies or health conditions.

You agree to use the Service only for lawful purposes. In addition to the Community Guidelines, you agree not to:

- Use the Service in any way that violates applicable laws or regulations - Attempt to reverse engineer, decompile, or disassemble any part of the Service - Use the Service to generate harmful, offensive, or illegal content - Interfere with or disrupt the Service or servers connected to the Service - Share or resell access to your account - Circumvent any usage limits or access controls - Scrape, copy, or redistribute community content or premium recipes without permission - Use automated scripts or bots to interact with the Service - Create multiple accounts to circumvent restrictions or bans

We reserve the right to suspend or terminate accounts that violate these Terms.

The Service, including its design, features, and software, is the property of Savoryy and is protected by intellectual property laws.

Your Content: You retain ownership of content you post to the Community (including recipes, photos, and comments). By posting, you grant Savoryy the license described in Section 4.

AI-Generated Content: AI-generated outputs may be used for your personal, non-commercial use. You may not use AI-generated content for commercial purposes without our prior written consent.

Third-Party Content: Community content posted by other users remains the property of those users. You may not copy, redistribute, or sell another user's content without their permission. Premium recipe content is licensed to you for personal use only upon purchase.

The Service may include links to third-party websites and embedded content from services such as YouTube, Instagram, and TikTok. Savoryy does not control and is not responsible for the content, accuracy, or availability of these external services.

You access third-party content at your own risk. Savoryy is not liable for any damage or loss arising from your use of third-party websites or services. Your use of third-party services is subject to their respective terms and policies.

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. Please review our Privacy Policy, which is incorporated into these Terms by reference.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY DEFECTS WILL BE CORRECTED.

USER-GENERATED CONTENT, INCLUDING COMMUNITY RECIPES AND PREMIUM RECIPES, IS PROVIDED BY OTHER USERS AND NOT BY SAVORYY. WE DO NOT VERIFY THE ACCURACY, SAFETY, OR COMPLETENESS OF USER-GENERATED CONTENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SAVORYY AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE THREE (3) MONTHS PRECEDING THE CLAIM.

SAVORYY IS NOT LIABLE FOR THE CONTENT POSTED BY USERS IN THE COMMUNITY OR FOR ANY INTERACTIONS BETWEEN USERS.

You may cancel your subscription at any time through your Apple ID Account Settings. Cancellation takes effect at the end of the current billing period; you will retain access until then.

You may delete your account at any time through the app's account settings. Upon deletion, your profile, community posts, and saved content will be removed.

We may terminate or suspend your account at any time, with or without cause or notice. Upon termination, your right to use the Service ceases immediately.

We may update these Terms from time to time. We will notify you of significant changes by posting the updated Terms within the App. Your continued use of the Service after changes constitutes acceptance of the updated Terms.

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of competent jurisdiction.
